    Extraordinary Regularization

    Second Draft of the Immigration Regulation Reform

    We are still waiting for the final publication, but these are the most important points to keep in mind:

    1. Who are the beneficiaries? (Target Groups)

    • Group A (Asylum Seekers): People who submitted an application for international protection or statelessness before January 1, 2026.
    • Group B (Extraordinary Arraigo): Foreign nationals who were in Spain before January 1, 2026 and did not apply for asylum (or do not hold other permits).

    2. Critical Deadlines

    • Entry deadline: You must have been in Spain before January 1, 2026.
    • Application window: The procedure can be applied for until June 30, 2026.
    • Resolution period: The administration has 3 months to resolve. If they don't respond within that time, the application is considered denied (negative administrative silence).

    3. Common Requirements (For both groups)

    • Physical presence: Being in Spain at the time of application.
    • Uninterrupted stay: Having been in Spain for the 5 months prior to the application (provable with census registration or other public/private documents).
    • Administrative status: Not having a valid stay or residence authorization (being irregular).
    • Criminal record: Having no criminal record in Spain or in countries where you have resided in the last 5 years.
    • Security: Not posing a threat to public order, national security, or public health.
    • Not having an entry ban or active non-return commitment.
    • Exclusion: Those with temporary protection due to the Ukraine conflict cannot apply.

    5. Immediate Benefits and Rights

    • Provisional Work Permit: From the moment the application is admitted for processing (before the final resolution), provisional authorization to reside and work (employed and self-employed) throughout the national territory is granted.
    • Expulsion file closure: If the person has an open expulsion or deportation file for irregular stay, granting this permit archives the file and revokes the order.
    • Permit duration: The granted authorization will be valid for 1 year.
    • Modification/Extension: Two months before the 1-year permit expires, you must apply for modification to a regular permit under the Immigration Regulation. If you don't meet the requirements for modification, it can exceptionally be extended if you demonstrate active job searching (SEPE registration) or an integration effort report (language learning, etc.).

    7. Family Facilities (Minors)

    • Simultaneous regularization: If the main applicant has minor children (or with disabilities) in Spain, or is a legal guardian, their residence can be applied for at the same time.

    Am I required to do my immigration procedure with a lawyer or a gestoría?

    The answer is clear: there is no legal obligation to do it with a professional. You can submit your application on your own if you choose to.
